Terms
These Rental Terms & Conditions (“Terms”) govern all vehicle rentals provided by Whips Inc.(“Company,” “we,” “us,” or “our”). By reserving, accepting, or operating a vehicle rented from Whips Inc., you (“Renter,” “you”) agree to be bound by these Terms and the Rental Agreement executed at the time of rental.

1. ELIGIBILITY & DRIVER REQUIREMENTS
• Renter must be at least 21 years of age (or such higher age as required for certain vehicles).
• Renter must possess a valid driver’s license throughout the rental period.
• Only drivers approved and listed on the Rental Agreement may operate the vehicle.
• Use of the vehicle by any unauthorized driver is strictly prohibited and voids all optional protections.

2. PERMITTED USE OF VEHICLE
The vehicle may be used only for lawful personal transportation purposes.
The following uses are strictly prohibited:
• Ride-share, livery, or transportation of passengers for hire (including but not limited to Uber, Lyft, taxi, or similar services), regardless of renter insurance
• Racing, speed testing, or off-road use
• Illegal activity
• Towing, pushing, or hauling any vehicle or trailer
• Operation while under the influence of alcohol, drugs, or any impairing substance
Any prohibited use constitutes a material breach of these Terms and may result in immediate termination of the rental and full financial responsibility.

3. LIABILITY COVERAGE (INCLUDED)
State-required automobile liability coverage is included with every rental, as required by California law.
This coverage:
• Applies to third-party bodily injury and property damage claims
• Does not cover damage to the rental vehicle
• Does not eliminate Renter’s responsibility for losses arising from prohibited or excluded conduct
Nothing in these Terms constitutes a guarantee of coverage beyond statutory requirements.
Whips Inc. does not guarantee coverage for any specific activity, including work or delivery use. Renters are responsible for understanding and complying with applicable insurance requirements.

4. OPTIONAL DAMAGE WAIVER (NOT INSURANCE)
An Optional Damage Waiver (“DW”) may be offered for an additional fee at the time of rental.
If accepted, Damage Waiver modifies the Renter’s financial responsibility for damage to or theft of the rental vehicle, subject to the terms and exclusions of the Rental Agreement.
Damage Waiver is not insurance and does not replace automobile insurance coverage.

5. DAMAGE WAIVER EXCLUSIONS
Damage Waiver does not apply, and Renter remains fully responsible, if damage or loss results from:
• Use by an unauthorized driver
• Driving under the influence of alcohol or drugs
• Reckless, negligent, or intentional conduct
• Ride-share, livery, or passenger-for-hire use
• Illegal activity
• Failure to promptly report an accident, theft, or vandalism
• Leaving the scene of an accident
• Providing false or misleading information

6. RENTER RESPONSIBILITY FOR DAMAGE
If Damage Waiver is declined or voided, Renter may be responsible for:
• The full cost of repair or replacement of the vehicle
• Loss of use
• Towing and storage
• Administrative fees
• Diminished value, where permitted by law

7. ACCIDENTS, THEFT, & INCIDENT REPORTING
Renter must:
• Immediately notify Whips Inc. of any accident, damage, theft, or vandalism
• Contact law enforcement when required by law
• Cooperate fully with investigations and insurance claims
Failure to comply with these requirements may result in full financial responsibility.

8. PAYMENTS, FEES, & TAXES
Renter agrees to pay:
• Rental charges
• Optional services selected
• Applicable taxes and government fees
All charges are subject to California sales and use tax where applicable.

9. VEHICLE RETURN
Renter must return the vehicle:
• On the agreed date and time
• To the designated return location
• In substantially the same condition as received, normal wear and tear excepted
Late returns, excessive cleaning, or additional mileage may result in additional charges.

10. TERMINATION OF RENTAL
Whips Inc. may terminate the rental immediately if:
• The vehicle is used in violation of these Terms
• False information is provided
• The vehicle is not returned as agreed

11. NO WAIVER
Failure by Whips Inc. to enforce any provision of these Terms shall not constitute a waiver of future enforcement.

12. GOVERNING LAW
These Terms and all rentals are governed by and construed in accordance with the laws of the State of California.

13. ENTIRE AGREEMENT
These Terms, together with the Rental Agreement executed at pickup, constitute the entire agreement between the parties.
